These Terms and Conditions (“Terms”) govern every purchase of merchandise, materials, and installation services from KB&A The Home Improvement Store, doing business as KBA Home Living (“KBA Home Living,” “we,” “us,” or “our”), whether your order is placed in our showroom, over the phone, or through www.kbahomeliving.com (the “Site”).

By placing an order, signing an estimate or installation agreement, or using the Site, you (“customer,” “you,” or “your”) agree to these Terms. If you do not agree, please do not place an order or use the Site.

Where a signed, itemized estimate, invoice, or installation agreement between you and KBA Home Living conflicts with these Terms, the signed document controls for that transaction; these Terms fill in anything the signed document does not address.

1. Definitions

  • “Merchandise” means any product sold by KBA Home Living, including fixtures, hardware, vanities, cabinets, countertops, and related home-improvement goods.
  • “Materials” means the physical goods (wood, laminate, quartz, stone, hardware, etc.) used to build or fabricate an item you ordered.
  • “Services” means installation, delivery, measuring/templating, or related labor performed by or on behalf of KBA Home Living.
  • “Order” means your request to purchase Merchandise and/or Services, as confirmed in writing (invoice, estimate, receipt, or agreement).
  • “Custom Order” means Merchandise that is cut, finished, fabricated, configured, or manufactured specifically to your specifications — see Section 3.

2. Products, Merchandise & Pricing

  • Product photos, renderings, samples, and descriptions are provided for general reference only. Because wood, stone, and other natural materials vary, and because screens display color differently, the finish, grain, and color of delivered Merchandise may vary from what you saw in a photo, sample chip, or showroom display. Natural variation is not a defect.
  • We reserve the right to accept, decline, limit the quantity of, or cancel any Order for any reason, including pricing or typographical errors, suspected fraud, or unavailability of Merchandise. If we cancel a paid Order, we will refund any amount you already paid for it.
  • Quoted prices are valid for the period stated on your estimate (or, if none is stated, 30 days) and are subject to change afterward. Sales tax, delivery, and installation are additional unless your estimate says otherwise.

3. Custom & Special-Order Materials (Vanities, Cabinets & Countertops)

Vanities, cabinets, countertops, and similar items are frequently built, cut, or finished specifically for you. This section applies to any such Custom Order.

  • Final measurements. Before production, we (or our installer) will confirm final measurements or a physical/digital template. Your quoted price may be adjusted based on the as-built measurements; we will notify you of any change before production begins.
  • Non-cancelable once in production. Once fabrication or production has started on a Custom Order, it is non-cancelable and non-returnable, except where the item arrives with a manufacturing defect or does not match the specifications you approved in writing.
  • Lead times. Estimated production and delivery windows are our best good-faith estimate, not a guarantee. Delays caused by manufacturers, mills, quarries, freight carriers, or events outside our reasonable control do not entitle you to cancel a Custom Order or to damages, though we will keep you updated.
  • Natural material variation. Wood grain, stone veining, and color intensity vary piece to piece. Reasonable variation from a sample or photo is expected and is not grounds for return or replacement.
  • Approval is final. Once you approve a template, cut list, or shop drawing in writing, changes are treated as a new Change Order under Section 6 and may add cost and time.

4. Deposits, Payment & Financing

  • A deposit of 50% of the total Order value is due to place a Custom Order or to schedule Installation Services. The remaining balance is due upon completion of installation or delivery, unless a different schedule is stated in your signed estimate.
  • We accept major credit and debit cards, cash, and check, as well as payment through our secure online checkout.
  • A returned check or declined payment may incur a service charge of the greater of $25 or 5% of the payment amount, as permitted under Florida law.
  • Past-due balances may accrue interest at 1.5% per month (18% annually) or the highest rate allowed by Florida law, whichever is lower.
  • Final payment is due upon substantial completion of Services and is not contingent on minor, warranty-covered touch-ups described in Section 8.

5. Delivery, Shipping & Inspection

  • Delivery windows are estimates and are not guaranteed for a specific date or time unless your estimate states otherwise.
  • Please inspect Merchandise at the time of delivery and note any visible damage directly on the delivery paperwork. Report concealed damage within 3 business days with photographs so we can file a timely claim with the manufacturer or carrier.
  • Risk of loss passes to you upon delivery, except that if KBA Home Living is also performing installation, risk of loss for the items being installed passes upon completion of installation and your walkthrough acceptance.
  • An adult (18 or older) must be present to receive delivery and, where applicable, to review and accept completed installation work.

6. Installation Services

Scope of work. Installation Services cover only the Merchandise and labor described in your written estimate or installation agreement. Work not listed there — including plumbing, electrical, drywall repair, flooring, or painting beyond incidental touch-up — is not included unless separately quoted and agreed in writing.

Your responsibilities before we arrive.

  • Provide clear, unobstructed access to the work area on the scheduled date.
  • Remove personal belongings, wall décor, mirrors, and fragile items from and near the work area — our installers are not responsible for items left in place.
  • Ensure electricity and water service are on and functioning at the property.
  • Tell us in advance about any known issues with plumbing, electrical, flooring, or structural conditions in the work area.

Pre-existing & site conditions. We are not responsible for pre-existing conditions we did not cause, including out-of-level floors or walls, outdated or non-code-compliant plumbing or wiring, mold, water damage, wood rot, or pest damage. If we discover such a condition once work has started, we will stop, notify you, and provide a Change Order describing any additional work, cost, and time needed before proceeding.

Plumbing & electrical. Unless your estimate expressly includes it, disconnecting or reconnecting plumbing, gas lines, or electrical wiring beyond a standard vanity/sink hookup is not included and may require a separately licensed plumber or electrician. We will tell you if your job needs this.

Licensing & permits. Where applicable Florida law requires a licensed contractor or a building permit for the scope of work you’ve ordered, we will let you know in advance and either arrange for appropriately licensed and insured tradespeople or advise you on the permits you’ll need to obtain.

Subcontractors. We may use qualified subcontractors to perform all or part of the Services. We remain responsible for the quality of completed work regardless of who performs it.

Change orders. Any change to the agreed scope of work — requested by you or required by site conditions — must be documented in writing (including by text or email) and agreed by both parties, along with any change in price or schedule, before that extra work begins.

Completion & acceptance. When installation is finished, we will walk through the completed work with you. Your signature on a completion form (or, if unavailable, your continued use of the installed Merchandise for more than 3 days without written objection) is treated as acceptance of the work.

Minor cosmetic items. Small scuffs, minor touch-up paint or caulk needs, or slight seam lines that do not affect function are considered normal for installation work and are handled under the workmanship warranty in Section 8 rather than treated as incomplete work.

7. Your Right to Cancel (Cooling-Off Period)

If you sign a purchase or installation agreement with us somewhere other than our regular place of business (for example, in your home) and the price is more than $25, federal and Florida law generally give you the right to cancel within three (3) business days of signing. Where this right applies, we will provide you with a separate written Notice of Cancellation at the time of signing.

This cooling-off right generally does not apply to purchases you make at our showroom or through the Site in the ordinary course, except where Florida or federal law says otherwise.

8. Returns, Exchanges & Order Cancellations

  • In-stock, non-custom Merchandise may be returned within 30 days of delivery if unused, in original packaging, and accompanied by proof of purchase, subject to a restocking fee of 15%.
  • Custom Orders (Section 3) are non-cancelable and non-returnable once production has begun, except for manufacturing defects or items that do not match your written specifications.
  • Orders canceled before shipment or before production begins may be canceled at no charge, or for a smaller fee to cover costs already incurred (such as a deposit paid to a manufacturer), at our discretion and as noted on your estimate.
  • Approved refunds are issued to your original payment method within 10 business days of approval.

9. Warranties

Manufacturer’s warranty. Most Merchandise is covered by the manufacturer’s own warranty. We will help you initiate a manufacturer warranty claim, but we do not extend, replace, or modify the terms of that warranty.

KBA Home Living workmanship warranty. We warrant our own installation workmanship against defects for one (1) year from the date of completion. This covers problems caused by our installation — for example, an improperly mounted cabinet, a failed seam caused by installation error, or misaligned doors/drawers due to install error.

What isn’t covered. This warranty does not cover normal wear and tear; misuse or neglect; unauthorized repairs or modifications by anyone other than KBA Home Living; damage from excess moisture, humidity, or temperature extremes; natural movement or settling of your home; acts of God; or damage caused by you, your household, pets, or other contractors.

Making a claim. To make a warranty claim, contact us at info@kbahomeliving.com or 561-313-1324 with your order number, a description of the issue, and photographs. We will inspect the issue and, at our option, repair or replace the affected item or workmanship.

10. Limitation of Liability

To the maximum extent permitted by Florida law, our total liability for any claim relating to Merchandise or Services is limited to the amount you paid for the specific item or service that gave rise to the claim.

We are not liable for incidental, consequential, special, or indirect damages — including loss of use of your kitchen or bathroom, loss of income, or the cost of temporary housing or alternative accommodations — arising from Merchandise or Services, to the fullest extent the law allows.

Nothing in these Terms limits any liability that cannot be limited under Florida law, including liability for gross negligence, willful misconduct, or personal injury caused by our negligence.

11. Indemnification

You agree to reimburse KBA Home Living for reasonable costs and damages arising from your misuse of Merchandise, your violation of these Terms, or false information you provided about site conditions that led to damage or injury. We agree to be responsible for damages caused by our own negligence or willful misconduct in performing Services.

12. Force Majeure

We are not responsible for delays or failures to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fire, labor disputes, supplier or carrier delays, material shortages, or government action. We will notify you and resume performance as soon as reasonably possible.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any lawsuit must be brought in a state or federal court located in Palm Beach County, Florida, unless applicable law requires otherwise.

Before filing a claim, both parties agree to try to resolve the dispute informally by contacting the other party in writing.

14. Intellectual Property & Website Use

All text, images, logos, and other content on the Site are owned by or licensed to KBA Home Living and may not be copied, distributed, or reused without our written permission, except for your own personal, non-commercial reference while shopping with us.

15. Privacy

Our collection and use of your personal information is described in our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time by posting the revised version on the Site. The version in effect on the date of your Order applies to that Order; your continued use of the Site after an update constitutes acceptance of the revised Terms.

17. General Provisions

  • Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
  • Entire agreement. These Terms, together with your signed estimate or installation agreement, are the entire agreement between you and KBA Home Living for that Order.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign your Order or these Terms without our written consent; we may assign our rights to an affiliate or successor business.
